Hush Local Terms of Service

1. Acceptance of Terms

These Terms of Service govern your access to and use of Hush Local, operated from Ontario, Canada. By accessing or using the website, progressive web application, related services, features, content, or subscriptions, you agree to be bound by these Terms and by all policies incorporated by reference, including our Privacy Policy, Community Guidelines, Acceptable Use Policy, Adult Content and User Upload Policy, Subscription Terms, and other policies posted on the site. If you do not agree, do not use the service.

2. Eligibility and Adult-Only Access

Hush Local is intended only for adults who are at least 18 years old, or older if required by applicable law. By using the service, you represent and warrant that you meet the minimum age requirement and have the legal capacity to enter into these Terms. You may not use the service if you are under 18 or if you are prohibited from using the service under applicable law.

3. Nature of the Service

Hush Local is an 18+ location-based social discovery and adult networking platform for casual encounters, kink-friendly connections, and adults connecting nearby. The service may include:

• user profiles;

• public and approximate map presence;

• private messaging;

• image uploads;

• albums;

• subscription features;

• location-based discovery;

• a paid “Invisible Mode”;

• a paid “Visit Here” or virtual travel feature;

• moderation and reporting tools. The service does not require matching before communication and does not guarantee social, romantic, sexual, or other outcomes.

4. User Accounts and Guest Sessions

The service may permit:

• guest sessions;

• free registered accounts; and

• paid subscriber accounts. You are responsible for maintaining the confidentiality of account credentials and for all activity under your account or guest session. Guests receive ordinary free-tier functionality while their temporary session is active. A registered account persists after logout; a guest profile is removed after its reconnection period expires, subject to safety, moderation, legal-retention, and preservation requirements.

5. Location and Map Features

The service uses location data to provide local discovery, approximate public map display, distance calculations, and related features. By using the service, you acknowledge and consent to the collection, use, and processing of your location data as described in the Privacy Policy and Location and Map Disclosure. The service may display an approximate public location rather than your exact location. Certain features may allow you to appear in a selected destination location through a paid virtual-travel feature. Virtual travel does not represent verified physical presence.

6. Public Visibility and Invisible Mode

By default, active users may appear on the map or other discovery surfaces while using the service. Paid subscribers may have access to Invisible Mode, which disables public map visibility for that account while preserving other permitted browsing functions. Invisible Mode does not mean total anonymity, deletion of records, or exemption from moderation, legal process, or security review.

7. User Content

You may upload, post, transmit, or share content such as profile information, photographs, messages, album content, and other materials, subject to these Terms and our policies. You represent and warrant that:

• you have all rights necessary to upload, share, and authorize use of the content;

• your content does not violate law or third-party rights;

• any images you upload depict you, unless you have another lawful right to upload them;

• you have obtained all necessary consents from any identifiable person in the content;

• your content complies with our policies. We may review content before publication, and we may remove, quarantine, restrict, or refuse content at our discretion, consistent with applicable law and our policies.

8. Moderation and Enforcement

We may monitor, review, investigate, quarantine, suspend, restrict, or remove content or accounts for any reason permitted by law, including suspected violations of these Terms or our policies. We may retain content, logs, and related data where necessary for safety, abuse prevention, dispute resolution, legal compliance, or lawful requests.

9. Prohibited Conduct

You may not:

• use the service if you are underage;

• impersonate another person;

• upload unlawful, fraudulent, defamatory, abusive, harassing, hateful, or exploitative content;

• upload CSAM or any content involving minors;

• upload non-consensual intimate imagery;

• use the service to traffic, exploit, coerce, or groom any person;

• solicit or facilitate prostitution, escort services, or other unlawful sexual services;

• threaten, extort, blackmail, or harass other users;

• attempt unauthorized access, scraping, reverse engineering, or abuse of the service;

• use the service for spam, malware, or automation contrary to our policies;

• violate any applicable law.

10. Private Messaging and Media

Private messages and private media are subject to moderation, safety review, abuse handling, and lawful access processes as described in our policies. Private does not mean inaccessible to administrators, moderators, or law enforcement where legally required or permitted.

11. Subscription Terms

Paid subscriptions are governed by our Subscription Terms and any checkout disclosures presented at purchase. By purchasing a subscription, you authorize recurring charges unless and until you cancel in accordance with the cancellation process.

12. Termination

We may suspend, restrict, or terminate access at any time where reasonably necessary to protect users, the platform, our legal interests, or third parties, or for suspected policy violations. You may stop using the service at any time and may request account deletion as described in our Privacy Policy and account settings, subject to retention obligations.

13. Intellectual Property

All rights in the service, branding, software, design, and content supplied by us are owned by us or our licensors. Except as expressly permitted, you may not reproduce, distribute, modify, or create derivative works from our materials.

14. Disclaimers

The service is provided on an “as is” and “as available” basis to the maximum extent permitted by law. We do not guarantee uninterrupted or error-free operation, nor do we guarantee safety, suitability, compatibility, or outcomes from user interactions.

15. Limitation of Liability

To the maximum extent permitted by law, we will not be liable for indirect, incidental, special, consequential, or punitive damages, or for losses arising from user conduct, content, offline interactions, or unauthorized access not caused by our gross negligence or willful misconduct where such limitations are enforceable.

16. Governing Law

These Terms are governed by the laws of Ontario and the federal laws of Canada applicable therein, without prejudice to mandatory consumer or privacy laws that may apply in other jurisdictions.
